O'Leary, Box Elder County ask for dismissal of lawsuit over citizen referendum

FOX 13 News Utah · Brigham City, Utah

Attorneys for Box Elder County and investor Kevin O'Leary have formally requested the dismissal of a lawsuit filed by local residents regarding the rejection of a citizen referendum. The lawsuit challenged the county commission’s decision to approve the Stratos Project, a data center development near the Great Salt Lake, which residents sought to put to a public vote.

Legal representatives argue that the county's actions were administrative rather than legislative, invoking the authority of the Military Installation Development Authority (MIDA) as the governing framework for the project. The defense emphasizes that the development had moved forward with private contracts before the county commissioners became involved, maintaining that their procedural actions were consistent with the law.

For the Box Elder community, this litigation represents a significant conflict over local land use and development transparency. With environmental concerns cited by protesters and several lawsuits already underway, the outcome of this case will likely shape future regional policy on industrial development and the influence of state-level authorities on local governance.
